Terms of Service

By accessing or using the funnl platform — including the web dashboard, public booking pages, WhatsApp booking assistant, marketing module, and any related services — you agree to be bound by these Terms of Service and our Privacy Policy. These Terms constitute a legally binding agreement between you and ZAIMAH Technologies (“Company”, “we”, “us”).

If you are using funnl on behalf of a business, you represent that you have authority to bind that business to these Terms.

funnl is an AI-powered business growth platform for SMEs across the UAE, built by ZAIMAH Technologies. It combines WhatsApp automation, AI-driven lead intelligence, appointment management, automated reminders, and multi-channel marketing into a single platform — enabling businesses to capture, qualify, convert, and retain customers at scale.

funnl serves businesses across multiple sectors including:

• Beauty and personal care (salons, barbershops, nail studios)
• Health and wellness (clinics, physiotherapy, spas, gyms, yoga studios)
• Professional services (legal, accounting, consulting, coaching)
• Real estate (agencies, property developers, brokers)
• Home services (maintenance, cleaning, interior design, pest control)
• Hospitality and food service
• Education and training centres
• Retail and e-commerce

funnl is operated by ZAIMAH Technologies, registered under SHAMS Free Zone, Sharjah, United Arab Emirates (UAE Trade Licence active).

3.1 Business Accounts: To access the funnl dashboard, businesses must register and provide accurate information. You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.

3.2 Eligibility: You must be at least 18 years old and legally authorised to operate a business in the UAE to register as a funnl business client.

3.3 Account Security: Notify us immediately at support@zaimahtech.ae if you suspect unauthorised access to your account. We are not liable for losses resulting from compromised credentials.

funnl provides the following services subject to your subscription plan:

4.1 WhatsApp AI Automation: An AI-powered conversational agent (Fatimah) that autonomously handles inbound WhatsApp messages 24/7 — answering enquiries, qualifying leads, booking appointments, managing reschedules and cancellations, and sending post-visit follow-ups. Fatimah adapts to your business sector, learns from customer interactions, and escalates complex conversations to human agents when required.

4.2 AI-Powered Lead Classification: Automated lead scoring and stage management that classifies inbound contacts as New, Booked, or Converted based on real-time conversation signals. The system tracks lead journey, assigns scores, and surfaces high-priority leads requiring immediate attention in your dashboard.

4.3 Appointment and Booking Management: A full-featured appointment system including:

• Service catalogue with pricing and duration
• Staff profiles with skills, working hours, and leave management
• Real-time availability checking and slot allocation
• Public self-service booking pages
• Multi-service bookings in a single appointment
• Schedule and calendar management
• No-show tracking and cancellation handling

4.4 Automated Reminders: WhatsApp-based appointment reminder sequences sent automatically before scheduled appointments to reduce no-show rates without manual intervention.

4.5 Multi-Channel Marketing Module: A campaign management platform enabling SMEs to plan, create, and launch marketing campaigns across multiple digital channels including:

• WhatsApp broadcast campaigns to opted-in contact lists
• Meta platforms (Facebook and Instagram) paid advertising
• Google and YouTube advertising campaigns
• AI-assisted copy and creative generation for ads
• Campaign performance tracking and analytics

The Marketing module integrates with Meta Business Manager and Google Ads. Actual ad spend is charged directly by the respective ad platforms and is entirely separate from funnl subscription fees. ZAIMAH Technologies is not responsible for ad performance, ad rejections, or ad account suspensions by Meta or Google.

4.6 CRM and Customer Intelligence: A unified customer relationship management system tracking full conversation history, booking history, AI quality scores, customer notes, and segment filtering by stage, source, and engagement level.

4.7 Analytics and Reporting: Business intelligence dashboards covering appointment volume, lead conversion funnel performance, revenue per service and staff member, WhatsApp AI quality ratings, and campaign ROI across channels.

4.8 Human Handover and Escalation: When the AI assistant detects situations requiring human judgment — including complaints, complex requests, or explicit escalation requests — it automatically notifies the assigned team member and pauses AI responses until resolution.

4.9 Multi-Tenant Infrastructure: Each business operates in a fully isolated tenant environment with dedicated data segregation, custom branding on booking pages, and sector-specific AI behaviour configuration.

You agree NOT to use funnl to:

• Send unsolicited messages or spam to WhatsApp contacts
• Collect personal data without proper consent
• Impersonate any person or business
• Violate any UAE federal or emirate-level law or regulation
• Process data of individuals under 13 years of age
• Violate Meta's WhatsApp Business Policy or Google Ads policies
• Transmit malicious code, viruses, or disruptive software
• Attempt to reverse-engineer or circumvent our platform security
• Use the AI assistant to provide regulated professional advice including medical diagnosis, legal advice, financial advice, or pharmaceutical recommendations without holding the required UAE professional licences and configuring appropriate disclaimers
• Run advertising campaigns for prohibited categories as defined by Meta and Google advertising policies

We reserve the right to suspend or terminate accounts that violate these terms without notice.

As a funnl business client, you acknowledge and agree that:

• You are responsible for obtaining valid opt-in consent from all contacts before messaging them via WhatsApp
• You must comply with Meta's WhatsApp Business Policy at all times
• You will only use approved message templates for proactive outreach
• You will not send prohibited content as defined in Meta's policies
• Account suspension by Meta due to your policy violations is not grounds for a refund or service credit from ZAIMAH Technologies
• You maintain your own privacy policy accessible to your customers

When using funnl's Marketing module to run campaigns on Meta or Google:

• You are solely responsible for ensuring your ad content complies with Meta Advertising Standards and Google Ads policies
• You must hold all necessary licences for your industry and sector
• Ad account restrictions or bans imposed by Meta or Google due to your content or behaviour are not grounds for refunds
• You authorise funnl to act as your agent in submitting campaigns to Meta and Google platforms on your behalf
• You remain the advertiser of record and retain full responsibility for ad content and targeting choices

8.1 Your Customers' Data: You are the data controller for your customers' personal data processed through funnl. ZAIMAH Technologies acts as a data processor on your behalf. You must have a lawful basis for processing your customers' data and maintain your own published privacy policy.

8.2 Our Use of Data: We process data as described in our Privacy Policy. We do not use your customers' data for our own marketing or sell it to third parties.

8.3 Data Processing Agreement: By accepting these Terms, you enter into a Data Processing Agreement with ZAIMAH Technologies. We will process personal data only on your documented instructions and in compliance with UAE PDPL.

9.1 Platform IP: All technology, software, designs, trademarks, and content comprising the funnl platform are owned by ZAIMAH Technologies and protected by UAE intellectual property law. You receive a limited, non-exclusive, non-transferable licence to use the platform during your subscription.

9.2 Your Content: You retain ownership of all content, data, and materials you upload to funnl. By uploading content, you grant us a limited licence to process and display it solely for the purpose of providing the platform services.

9.3 AI-Generated Outputs: Content generated by funnl's AI assistant and marketing tools is produced on your behalf. You are responsible for reviewing and validating AI-generated content used in your business operations and advertising.

10.1 Plans: funnl is offered on subscription plans published at funnl.zaimahtech.ae. Plan features, limits, and pricing are subject to change with 30 days notice.

10.2 Payment: Payments are processed in UAE Dirhams (AED). All fees are exclusive of VAT, which will be added where applicable under UAE Federal Decree-Law No. 8 of 2017 on Value Added Tax.

10.3 Ad Spend: Advertising spend on Meta, Google, and other platforms is billed directly by those platforms to your linked payment method. funnl subscription fees do not include ad spend.

10.4 Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods.

10.5 Suspension for Non-Payment: We reserve the right to suspend access to funnl for accounts with overdue payments after 7 days written notice.

We aim to maintain 99% platform uptime excluding scheduled maintenance. Scheduled maintenance will be communicated with at least 24 hours notice via email. We are not liable for downtime caused by third-party services including Meta, WhatsApp, Anthropic, Google, or cloud infrastructure providers.

To the maximum extent permitted by UAE law:

12.1 We are not liable for:

• The quality of services provided by businesses using funnl to their customers
• Loss of bookings, revenue, or customers due to platform downtime
• Actions taken by Meta or Google including account restrictions or bans
• AI assistant errors, omissions, or miscommunications
• Ad campaign performance, reach, or return on investment
• Indirect, consequential, or punitive damages of any nature

12.2 Our maximum aggregate liability for any claim shall not exceed the total fees paid by you to ZAIMAH Technologies in the 3 months preceding the claim.

12.3 Nothing in these Terms limits liability for fraud, wilful misconduct, or death or personal injury caused by our negligence.

You agree to indemnify and hold harmless ZAIMAH Technologies, its directors, employees, and agents from any claims, losses, or expenses (including legal fees) arising from: your use of funnl, your violation of these Terms, your violation of any third-party rights, your breach of UAE PDPL, or your non-compliance with Meta's or Google's advertising and messaging policies.

We reserve the right to modify, suspend, or discontinue any feature of funnl with reasonable notice. We will provide at least 30 days notice for material changes that significantly affect your use of the platform.

15.1 These Terms are governed by the laws of the United Arab Emirates, specifically the laws of the Emirate of Sharjah and applicable UAE federal laws.

15.2 Any dispute shall first be attempted to be resolved through good-faith negotiation within 30 days of written notice to support@zaimahtech.ae.

15.3 Unresolved disputes shall be submitted to the courts of Sharjah, UAE, which shall have exclusive jurisdiction.

15.4 Nothing prevents either party from seeking urgent injunctive relief from a competent court.

16.1 Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and ZAIMAH Technologies regarding funnl.

16.2 Severability: If any provision is found unenforceable, the remaining provisions continue in full force.

16.3 Waiver: Failure to enforce any provision does not constitute a waiver.

16.4 Assignment: You may not assign your rights without our written consent. We may assign our rights to a successor entity.

16.5 Force Majeure: Neither party is liable for failures caused by circumstances beyond reasonable control including natural disasters, government actions, or infrastructure failures.

16.6 Language: These Terms are drafted in English. In the event of any conflict with a translated version, the English version prevails.
